Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated NOVEMBER 20, 2006, executed by PAMELA JOY CARROLL, AN UNMARRIED WOMAN, to EMMETT JAMES HOUSE OR BILL R. MCLAUGHLIN, A RESIDENT OF CORDOVA, TENNESSEE, Trustee, of record in DEED OF TRUST 384, PAGE 2699, for the benefit of REGIONS BANK D/B/A REGIONS MORTGAGE, in the Register's Office for MCNAIRY County, Tennessee and to J. PHILLIP JONES AND/OR JESSICA D. BINKLEY, either of whom may act, appointed as Substitute Trustee in an instrument of record in the Register's Office for MCNAIRY County, Tennessee, to secure the indebtedness described, the entire indebtedness having been declared due and payable by REGIONS BANK D/B/A REGIONS MORTGAGE, being the present owner/holder or authorized agent, designee or servicer of the holder/owner of said indebtedness, has requested foreclosure proceedings to be instituted; and as provided in said Deed of Trust, I, J. NOTICE OF SUBSTITUTE TRUSTEE'S SALE
OF REAL ESTATE
WHEREAS, on March 7, 2002, KATHLEEN SIMMONS, now deceased, by Deed of Trust of record in Deed of Trust 326, at Page 359, in the Register's Office of McNairy County, Tennessee, conveyed the following described property in trust to secure the payment of a Promissory Note in the original principal amount of Twenty Nine Thousand Two Hundred Fifty and 00/100 Dollars ($29,250.00), payable to Banker's Mortgage Company; The Deed of Trust was assigned to Community Choice Financial Services by an Assignment dated February 10, 2003, and of record in Deed of Trust Book 346, at Page 353, in the Register's Office of McNairy County, Tennessee. Community Choice Financial Services, Inc.'s name was changed to First State Finance, Inc. on December 28, 2006. First State Finance, Inc.'s name was changed to Simmons First Finance Company on September 3, 2015 (See Tennessee Secretary of State #B0126-7136); reference to which is hereby made; and
WHEREAS, the undersigned was appointed Substitute Trustee by Simmons First Finance Company, the legal owner and holder of the said Note, by an appointment dated October 6, 2015, of record in Deed of Trust 418, at Page 54, in the Register's Office of McNairy County, Tennessee; and
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and Simmons First Finance Company, the lawful owner and holder of the indebtedness, has declared the entire amount due and payable as provided by the Deed of Trust in accordance with its terms, and instructed the undersigned to foreclose.
NOW, THEREFORE, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand paid, at the east door of the Courthouse at Selmer, McNairy County, Tennessee, on Monday, November 30, 2015, at 10:00 o'clock a.m., said property to be sold in bar of the equity of redemption and subject to the lien of all special assessments against it. Lying, and being situate in the 1st Civil District of McNairy County, Tennessee, bounded and described as follows; to-wit:

BEGINNING at a point in the center of Center Hill Road due South of the ditch which roughly approximates the western border of this property; thence north 11 degrees West 451 feet along the ditch to a stake; thence following the ditch North 10 degrees 50 minutes East to a point; thence North 21 degrees 30 minutes West to a point in the center of the ditch on Phillips boundary line; thence with Phillips boundary line South 89 degrees 00 minutes East to a point thence South 4 degrees 15 minutes East 1,022 feet to a point in the center of Center Hill Road; thence South 76 degrees 40 minutes West to the point of beginning. Being the same property conveyed to J. M. Simmons and wife, Kathleen Simmons by deed dated December 13, 1976 and recorded in Deed Book 86, Page 630 in the Register's Office of McNairy County, Tennessee. J. M. Simmons deceased. Kathleen Simmons became owner of the property as surviving tenant by the entirety upon the death of her husband, J. M. Simmons, on August 5, 1984. Kathleen Simmons died testate, a resident of McNairy County, Tennessee, on November 6, 2014, and by her Will of record in Deed Book 233, page 613, Register's Office of McNairy County, Tennessee, she devised her home and five (5) acres to her daughter, Sandra Simmons. Sandra Simmons died intestate on May 6, 2015, and was survived by her daughter, Leah Gunn, and son, Jason Mitchell, the sole heirs at law of Sandra Simmons, under the laws of intestate succession.

The street address of the above described property is believed to be 6972 Center Hill Rd., Finger, Tennessee, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. Notice is hereby given that on November 3, 2015, Letters Testamentary in respect to the Estate of JOE D. BUTLER, deceased, were issued to the undersigned by the Chancery Court Clerk & Master of McNairy County, TN.
All persons, resident and non-resident, having claims, matured or unmatured, against his Estate are requested to file the same in triplicate with the Clerk & Master of the above named Court on or before the earlier of the dates precribed in (1) or (2); otherwise, their claims will be forever barred:
