NOTICE OF SUBSTITUTE TRUSTEE'S SALE
OF REAL ESTATE

WHEREAS, on May 23, 2005, Jonathan Hammons, unmarried and Dennis E. Hammons, unmarried, by Deed of Trust of record in Deed of Trust 375, at Page 1693, in the Register's Office of McNairy County, Tennessee, conveyed the following described property in trust to secure the payment of a Promissory Note in the original principal amount of Ninety Three Thousand Five Hundred and 00/100 Dollars ($93,500.00), payable to FARM CREDIT MID-AMERICA, FLCA; and
WHEREAS, the undersigned was appointed Substitute Trustee by FARM CREDIT MID-AMERICA, the legal owner and holder of the said Note, by an appointment dated March 3, 2016 and of record in Deed of Trust 419, at Page 718, in the Register's Office of McNairy County, Tennessee; and
WHEREAS, default has been made in the payment of said indebtedness and other provisions of the Deed of Trust have been violated, and FARM CREDIT MID-AMERICA, FLCA, the lawful owner and holder of the said indebtedness, has declared the entire amount due and payable as provided by the Deed of Trust in accordance with the terms thereof, and instructed the undersigned to foreclose.
NOW, THEREFORE, the public is hereby notified that the undersigned Substitute Trustee will sell the hereinafter described real estate at public auction, to the highest and best bidder, for cash in hand paid, at the east door of the Courthouse at Selmer, McNairy County, Tennessee, on Wednesday, April 27, 2016, at 10:00 o'clock a.m., said property to be sold in bar of the equity of redemption and subject to the lien of all special assessments against it. If the highest bidder cannot pay the bid within a reasonable time to be announced at the sale, the next highest bidder will be deemed the successful bidder.
Lying, and being situate in the 5th Civil District of McNairy County, Tennessee, bounded and described as follows; to-wit:

TRACT NO. 1: BEGINNING at an iron pin, said iron pin being located in the West margin of U.S. Highway 45, the NEC of the E.D. Richard home tract, and the SEC of the Jeffery Allen Walker tract as described in Deed Book 86, page 465, in the Register's Office of McNairy County, Tennessee; thence 19.5 degrees West of North with the meanders of said Highway, 100 feet to an iron pin; thence in a Western direction 400 feet to an iron pin; thence in a Southern direction parallel with U.S. Highway 45, 100 feet to an iron pin, said iron pin being located in the E.D. Richard North line; thence in an Eastern direction along and parallel with Richard's North line, 400 feet to the point of beginning, and being a lot 100 feet by 400 feet.

INCLUDED IN THE FOREGOING DESCRIPTION AND EXPRESSLY EXCLUDED herefrom is a lot heretofore conveyed by James F. Burks to E.D. Richard and wife, Mai Del Richard, by warranty deed dated 6/25/87 of record in D.B. 118, Page 392, Register's Office of McNairy County, Tennessee, and which tract is more particularly bounded and described as follows; to wit: BEGINNING at an iron pin located in the NWC of that tract of record in D.B. 118, pg. 272, the SWC of the Griffin tract; thence in an Eastern direction with Griffin's South line, the North line of the Burks tract, 70 feet; thence in a Southern direction 100 feet to an iron pin located in the South line of Burks, a North line of the E.D. Richard home tract; thence in a Western direction, with Richard's North line, 70 feet to an iron pin, the SWC of that tract of record in D.B. 118, pg. 272; thence in a Northern direction 100 feet to the point of beginning, and being a lot 100 foot x 70 foot.

TRACT NO. 2: BEGINNING at an iron pin located in the West margin of U.S. Highway #45, the SEC of the Burks tract of record in Deed Book 118, page 272, and the NEC of the Richard home tract of which this is a portion, of record in Deed Book 30, page 537; thence in a Southern direction with the West margin of said Highway, 20 feet; thence in a Western direction and at all times parallel with the Richard North line, the Burks' South line, 330 feet to an iron pin; thence in a Northern direction 20 feet to an iron pin; thence in an Eastern direction with Richard's North line, Burks' South line, 330 feet to the point of beginning, being a lot 330 feet x 20 feet.

E.D. Richard, et ux, reserved unto themselves and their successors in title the perpetual right of ingress and egress over a portion of the tract hereinabove conveyed for the purposes of cultivating peach trees which are situated adjacent to the hereinabove described property. See Deed Book 118, page 394, said Register's Office.

INCLUDED IN THE FOREGOING DESCRIPTIONS BUT EXCLUDED FROM THIS CONVEYANCE IS A PARCEL OF LAND CONTAINING 2,684, SQUARE FEET CONVEYED TO THE STATE OF TENNESSEE FOR HIGHWAY PURPOSES IN D.B. 139, PG 337, SAID REGISTER'S OFFICE AND THIS CONVEYANCE IS MADE SUBJECT TO THE TEMPORARY SLOPE EASEMENT AND THE TEMPORARY CONSTRUCTION EASEMENT DESCRIBED THEREIN.
